By accessing our website, submitting an order, making a payment, or using our services, you agree to these Terms and Conditions.

1. Our Services

CallAutomateAI provides AI voice agent and calling automation services, including:

  • Inbound call handling and routing
  • Outbound calling workflows
  • Lead qualification and scoring
  • Appointment booking
  • Calendar and CRM integrations
  • Multilingual voice support
  • Call recording and transcription
  • Quality monitoring
  • Customer feedback calls
  • Call analytics and reporting
  • Ongoing call-flow optimisation

The exact features, limits, integrations, workflows, languages, and support included in your service will depend on the plan purchased and the agreed project scope.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase our services.

Where you purchase services on behalf of a company or organisation, you confirm that you have authority to accept these Terms on its behalf.

3. Service Plans and Pricing

Our available plans may include:

  • Essentials: $749 setup
  • Growth: $1,199 setup
  • Scale: $1,799 setup

Optional monthly Care & Optimization Plans may be offered at:

  • Essentials: $229 per month
  • Growth: $329 per month
  • Scale: $429 per month

Prices, features, limits, and availability may be updated from time to time. The pricing and scope confirmed at the time of purchase will apply to that order.

Unless stated otherwise, third-party usage charges, telephone carrier fees, CRM subscriptions, software subscriptions, premium integrations, and additional call-volume costs are not included.

4. Orders and Payments

An order is considered accepted after payment has been successfully received and we have confirmed the project scope.

You agree to provide complete and accurate billing, business, technical, and project information.

We may suspend or delay work where:

  • Payment has not been completed
  • Required information has not been provided
  • The requested use appears unlawful or prohibited
  • The project exceeds the purchased plan
  • Third-party access or approvals are unavailable

You are responsible for any taxes, transaction fees, or other charges applicable to your purchase.

5. Final Purchases and No Refunds

Due to the digital, customised, and virtual nature of our services, all purchases are final and non-refundable.

Once payment has been made and work has started, no refund, partial refund, exchange, or cancellation credit will be provided, except where required by applicable law.

You should review the selected plan, included features, project requirements, and pricing carefully before purchasing.

6. Delivery Time

Our standard estimated delivery time is 7 to 14 days.

Delivery time may vary based on:

  • Project size and complexity
  • Number of workflows
  • Required languages
  • CRM or calendar integrations
  • Client response time
  • Availability of third-party platforms
  • Requested revisions
  • Technical or compliance requirements

Delivery estimates begin only after we have received payment and all necessary project information.

Delays caused by missing information, delayed approvals, third-party services, scope changes, or circumstances outside our reasonable control will not constitute a breach of these Terms.

7. Revisions

We provide unlimited revisions within the original agreed project scope.

Revisions may include reasonable changes to:

  • Scripts
  • Call-flow wording
  • Routing logic
  • Prompts
  • Greetings
  • Knowledge-base responses
  • Supported integrations already included in the plan

Unlimited revisions do not include:

  • A completely new project
  • New workflows beyond the purchased plan
  • A change to an unrelated business or campaign
  • Additional languages not included in the plan
  • New third-party integrations
  • Major redesigns after final approval
  • Additional services not included in the original order

Requests outside the agreed scope may require an additional fee.

8. Client Responsibilities

You agree to provide all information reasonably required to complete the project, including:

  • Accurate business information
  • Approved scripts and FAQs
  • Call-routing instructions
  • Appointment and scheduling rules
  • Customer service policies
  • Contact lists where applicable
  • Required login or integration access
  • Legal disclosures and compliance instructions
  • Timely feedback and approvals

You are responsible for reviewing and approving all scripts, voice responses, workflows, integrations, and test calls before launch.

9. Calling Compliance

You are solely responsible for ensuring that your use of the services complies with all applicable laws, regulations, industry standards, and platform policies.

This includes requirements relating to:

  • Prior consent for automated or AI-generated calls
  • Telemarketing and advertising communications
  • Do Not Call lists
  • Opt-out and revocation requests
  • Permitted calling hours
  • Caller identification
  • Artificial voice disclosures
  • Call recording and transcription notices
  • Privacy and data protection
  • Contact-list sourcing
  • Marketing claims
  • Industry-specific restrictions

The FCC treats AI-generated voices as artificial or prerecorded voices under the TCPA, and the FTC’s Telemarketing Sales Rule includes disclosure, calling-time, misrepresentation, and Do Not Call obligations.

CallAutomateAI does not provide legal advice, compliance certification, or approval of any campaign. You should obtain independent legal advice before using automated calling services.

10. Prohibited Uses

You must not use our website or services for:

  • Unlawful robocalling or telemarketing
  • Calling individuals without required permission
  • Ignoring opt-out or Do Not Call requests
  • Fraud, scams, impersonation, or deceptive practices
  • Harassment, threats, or abusive communications
  • False or misleading representations
  • Political manipulation or unlawful campaigning
  • Emergency-service impersonation
  • Collection of unlawful or unnecessary sensitive data
  • Promotion of illegal products or services
  • Violation of third-party rights
  • Malware, phishing, or unauthorised account access

We may refuse, suspend, or terminate any project that we reasonably believe involves prohibited or unlawful activity.

11. AI Limitations

AI voice agents may occasionally:

  • Misunderstand a caller
  • Provide an incomplete or inaccurate response
  • Mispronounce names or words
  • Fail to recognise accents or background noise
  • Route a call incorrectly
  • Experience delays or outages
  • Produce an unexpected response
  • Fail due to third-party platform issues

You acknowledge that AI systems are not error-free and should be monitored appropriately.

Our services must not be relied upon as a substitute for emergency assistance, medical advice, legal advice, financial advice, or other professional human judgement.

12. Third-Party Platforms

Our services may rely on third-party platforms, including:

  • Telephony providers
  • AI model providers
  • CRM software
  • Calendar systems
  • Hosting services
  • Payment processors
  • Email providers
  • Analytics services
  • Live chat systems

Third-party providers operate under their own terms, privacy policies, pricing, usage limits, and availability.

We are not responsible for third-party outages, account restrictions, pricing changes, API changes, data loss, security incidents, or service discontinuation.

You may be required to maintain active third-party accounts or subscriptions at your own expense.

13. Call Volume and Usage Limits

Each plan includes specified call-volume and workflow limits.

If your usage exceeds the purchased plan, we may:

  • Request that you upgrade your plan
  • Charge additional usage fees
  • Pause certain workflows
  • Limit call volume
  • Recommend a custom plan

Unused call allowances do not automatically roll over unless confirmed in writing.

14. Monthly Care and Optimization Plans

Optional Care & Optimization Plans may include ongoing tuning, reporting, monitoring, and reasonable workflow improvements.

Monthly plans continue until cancelled according to the agreed billing arrangement.

Cancellation will stop future renewals but will not create a refund for payments already processed.

Major new workflows, new integrations, increased call volume, or substantial scope changes may require separate fees.

15. Intellectual Property

CallAutomateAI retains ownership of its pre-existing systems, methods, templates, processes, technical configurations, know-how, and reusable materials.

After full payment, you may use the final project materials created specifically for your business, subject to any third-party platform restrictions.

You confirm that any scripts, trademarks, data, recordings, documents, or materials you provide belong to you or that you have permission to use them.

You grant us permission to use those materials only as reasonably necessary to provide the purchased services.

16. Confidentiality

We will take reasonable steps to protect confidential business information provided for your project.

You agree not to disclose or misuse our confidential technical processes, internal documentation, pricing arrangements, or proprietary materials.

Confidentiality obligations do not apply to information that:

  • Is already publicly available
  • Was lawfully known before disclosure
  • Is independently developed
  • Must be disclosed by law
  • Is received lawfully from another source

17. Data and Privacy

Personal information will be handled in accordance with our Privacy Policy.

Where you provide customer or caller data, you confirm that you have the lawful authority to collect, use, share, and process that information.

You are responsible for providing legally required notices and obtaining consent for call recording, transcription, AI processing, and automated communications.

18. Service Suspension or Termination

We may suspend or terminate services where:

  • Payments are overdue
  • These Terms are violated
  • The service is used unlawfully
  • Required cooperation is not provided
  • Third-party providers restrict the service
  • The project creates legal, security, or reputational risk
  • You engage in abusive or threatening conduct

Termination for prohibited activity does not entitle you to a refund.

19. No Guaranteed Results

We do not guarantee:

  • Sales
  • Leads
  • Appointments
  • Revenue
  • Conversion rates
  • Cost savings
  • Caller satisfaction
  • Campaign performance
  • Continuous availability
  • A particular response from callers

Results depend on many factors outside our control, including contact quality, consent, scripts, offers, market conditions, customer behaviour, technical availability, and client operations.

20. Limitation of Liability

To the fullest extent permitted by law, CallAutomateAI will not be liable for indirect, incidental, special, punitive, or consequential losses.

This includes loss of:

  • Revenue
  • Profits
  • Customers
  • Leads
  • Data
  • Reputation
  • Business opportunities
  • Service availability

Our total liability relating to a specific order will not exceed the amount paid to CallAutomateAI for that order during the period giving rise to the claim.

21. Indemnification

You agree to defend, indemnify, and hold harmless CallAutomateAI and its contractors from claims, penalties, losses, damages, liabilities, and reasonable legal costs arising from:

  • Your use of the services
  • Your calling campaigns
  • Your contact lists or data
  • Your scripts, claims, or offers
  • Your failure to obtain consent
  • Your violation of telemarketing, privacy, recording, or consumer laws
  • Your breach of these Terms
  • Your infringement of third-party rights

22. Force Majeure

We will not be responsible for delays or failures caused by events outside our reasonable control, including:

  • Internet or telecommunications failures
  • Third-party outages
  • Cyberattacks
  • Natural disasters
  • Government actions
  • Labour disputes
  • Power failures
  • Platform restrictions
  • Changes in law or regulation

We do not guarantee that all website information will always be complete, error-free, or continuously available.

Changes will apply to future use of the website and services. Material changes to an active paid project will not normally alter the confirmed scope of that order unless agreed by both parties or required by law.

25. Governing Law and Disputes

These Terms will be governed by the laws applicable to the location from which CallAutomateAI operates, without regard to conflict-of-law principles.

Before beginning formal proceedings, both parties agree to make a reasonable attempt to resolve any dispute through written communication.

Any dispute that cannot be resolved informally will be handled by the courts or dispute-resolution forum with lawful jurisdiction over the matter.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

27. Entire Agreement

These Terms, together with the Privacy Policy, Cookies Policy, Disclaimer, confirmed order details, and any written service agreement, form the entire agreement between you and CallAutomateAI regarding the services.
